Enforcement of Judgments
It Is Not Over When You Win Your Lawsuit
If you have been awarded a judgment in a civil lawsuit, that does not necessarily mean that you will be paid. The court does not take it upon itself to help you collect your judgment, and neither do most attorneys who handle civil lawsuits. At Chora Young LLP, we have the legal knowledge, skills, and perseverance to win your judgment AND help you collect it.
Many people believe that a civil lawsuit battle is over when they have won a judgment in court, when in fact the battle to collect what is due and owing is only beginning at that point. Three of our attorneys at Chora Young LLP are also private investigators, and the main focus of our practice is enforcing judgments.
Locating Missing Debtors
Judgment debtors have a tendency to disappear to avoid collection efforts. Our Pasadena judgment enforcement attorneys provide skip tracing services to locate missing debtors so you can collect.
Asset Investigations
Debtors conceal assets to avoid collection through various methods, including transferring property to companies, family members, or other individuals. Our asset investigators know how to uncover hidden assets and identify camouflaged ownership interests.
Debtor Examinations
If a debtor will not voluntarily pay your judgment, we can compel the debtor to appear in court for a Debtor Examination, at which time we can obtain information about the debtor’s income and assets and also compel the production of financial records, such as bank statements, paystubs, and property deeds. A debtor who fails to appear may be in held contempt of court, with a bench warrant issued for his or her arrest.
Asset Seizure and Liquidation
Once a debtor’s assets are located, our California judgment enforcement attorneys can handle the legal processes involved with seizing and liquidating those assets to pay your judgment. Wages and bank accounts are the easiest assets to levy, but personal property can also be seized.
Debtor Bankruptcies: Representing Judgment Creditors
When all else fails, judgment debtors often file personal or business bankruptcy. Our experienced judgment enforcement lawyers can represent your interests in the 341 hearing (Meeting of Creditors) with the bankruptcy trustee and give valuable guidance when debtor turns to bankruptcy protection to avoid a the enforcement of a judgment.
